Please read these Terms of Use ("Terms", "Terms of Use") carefully before using the websites www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk, and www.betterbaths.co.uk (collectively referred to as the "Services") operated by Better Kitchens Ltd ("us", "we", or "our").
Better Worktops, Better Bedrooms, and Better Baths are trading names of Better Kitchens Ltd.
Your access to and use of the Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Services.
By accessing or using the Services you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Services.
These Terms shall be governed and construed in accordance with the laws of the United Kingdom, without regard to its conflict of law provisions.

INTRODUCTION
1.1 You will be able to access most areas of these Websites (www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk, and www.betterbaths.co.uk) without registering your details with us. Certain areas of these Websites are only open to you if you register.
1.2 We may revise these terms and conditions at any time by updating this posting. You should check these Websites from time to time to review the then-current terms and conditions, because they are binding on you. Certain provisions of these terms and conditions may be superseded by expressly designated legal notices or terms located on particular pages of these Websites. If you do not wish to accept any new terms and conditions after we have given notice, you should not continue to use these Websites.
ORDERING FROM US
2.1 You are deemed to have placed an order with us by ordering via our online checkout process on any of the Websites (www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk, and www.betterbaths.co.uk) OR verbally by phone. As part of our online checkout process, you will be given the opportunity to check your order and to correct any errors. We will send you an order acknowledgement detailing the products you have ordered.
2.2 Our acceptance of an order takes place when we dispatch the order. We will send you a dispatch confirmation by email. When we dispatch the order, the purchase contract will be made even if your payment has been processed immediately, unless we have notified you that we do not accept your order or you have cancelled your order.
2.3 We may refuse to accept an order:
(a) where goods are not available;
(b) where we cannot obtain authorisation for your payment;
(c) if there has been a pricing or product description error; or
(d) if you do not meet any eligibility criteria set out in our terms and conditions.
DELIVERY OF GOODS TO YOU
3.1 We will deliver the Goods ordered by You from any of our Websites (www.betterkitchens.co.uk,www.betterworktops.co.uk,www.betterbedrooms.co.uk, and www.betterbaths.co.uk) to the address You give us for delivery at the time You make your order, and in accordance with the level of delivery service You have selected at the time You make Your order.
3.2 You will become the owner of the Goods You have ordered when they have been delivered to You. Once Goods have been delivered to You, they will be held at Your own risk and We will not be liable for their loss or destruction.
3.3 Any dates specified by Us for delivery of the Goods are intended to be an estimate and time for delivery shall not be made of the essence by notice. If no dates are so specified, delivery shall be within a reasonable time.
3.4 Subject to the other provisions of these terms and conditions, We shall not be liable for any direct, indirect, or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery of the Goods nor shall any delay entitle You to terminate the Contract unless such delay exceeds 30 days and subject to our CANCELLATION AND RETURNS POLICY. See section 6.4.
3.5 If for any reason You fail to accept delivery of any of the Goods, or We are unable to deliver the Goods on time because You have not provided appropriate labour, instructions, documents, licenses or authorisations:
(A) risk in the Goods shall pass to You;
(B) the Goods shall be deemed to have been delivered; and
(C) We may store the Goods until delivery, whereupon You shall be liable for all related costs and expenses (including, without limitation, storage, costs of rearranging delivery and insurance).
3.6 You must ensure that, at Your own expense, adequate and appropriate equipment and manual labour is available for unloading the Goods at the place where the Goods are to be delivered according to the delivery service You selected at the time You made Your order.
3.7 We may deliver the Goods to You by separate instalments. In such cases, We will endeavour to coordinate the separate deliveries as much as possible.
3.8 Each instalment shall be a separate Contract and no cancellation or termination of any one Contract relating to an instalment entitles You to repudiate or cancel any other Contract or instalment.
3.9 Upon delivery of the Goods, You are responsible for inspecting the Goods and reporting to Us within 2 working days any alleged defect, fault or error before the Goods are used or fitted. Any liability of Us for delayed, defective, faulty or non-delivery of the Goods shall be limited to replacing the Goods within a reasonable time. We shall have no liability for any claim in respect of an alleged defect, fault or error which would be apparent on inspection before use or fitting.
NON-DELIVERY
4.1 The quantity of any delivery of Goods as recorded by Us or Our suppliers upon dispatch from Our or Our supplier’s place of business shall be conclusive evidence of the quantity received by You on delivery unless You can provide conclusive evidence proving the contrary.
4.2 We shall not be liable for any non-delivery of Goods (even if caused by Our own negligence) unless You give written notice to Us of the non-delivery within 2 working days of the date when the Goods would in the ordinary course of events have been received.
4.3 Any liability of Us for non-delivery of the Goods, whether ordered through www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk, or www.betterbaths.co.uk, shall be limited to replacing the Goods within a reasonable time.
4.4 If You, the Customer, are not present on an agreed delivery day and the Goods are not delivered due to this, then a re-delivery charge will be applied at the current delivery rate for the products ordered.
PRICING
5.1 All prices are shown without VAT and with VAT (where applicable) at the current rates on our Websites (www.betterkitchens.co.uk,www.betterworktops.co.uk,www.betterbedrooms.co.uk, and www.betterbaths.co.uk). We reserve the right to express the price exclusive of VAT, but we shall show VAT separately and include it in the total price.
5.2 Where we charge separately for packing, carriage, and insurance and other relevant charges, the appropriate rates are set out in our specified pricing structure shown elsewhere on these Websites.
5.3 Our prices are reviewed periodically and any changes will be reflected in the prices displayed online across all our Websites.
CANCELLATION AND RETURNS POLICY
PLEASE NOTE: Our kitchens (Includes kitchen Units/Carcasses and anything constructed from MFC carcase material or Kitchen Doors and their related products that are produced in the same finish/colour as the door style, e.g. End Panels, Plinth, Trims, etc) are 'Made to Order' and cannot be cancelled or returned for any reason and are subject to our CANCELLATION AND RETURNS POLICY. See section 6.4.
6.1 If you wish to cancel your order made on any of our Websites (www.betterkitchens.co.uk,www.betterworktops.co.uk,www.betterbedrooms.co.uk, and www.betterbaths.co.uk):
(a) you can notify us by logging into your account and raising a support ticket before we have dispatched the goods to you; or
(b) where goods have already been dispatched to you, by returning goods to us in accordance with clause 6.2 below.
6.2 You can return goods you have ordered from us (excluding items which are 'made to order' or other 'special order items') for any reason at any time within 14 days of receipt for a refund (full refund only available if unopened and in resalable condition i.e. not covered in customers packing tape, cup marks, etc) or exchange. - PLEASE NOTE: WE DO NOT REFUND DELIVERY CHARGES AND A 25% RESTOCKING FEE MAY BE CHARGED ON ALL NON-FAULTY RETURNS. Kitchen Carcasses and Kitchen Doors are 'Made to Order', and made to your chosen specification, and thus are not returnable or cancel-able. Kitchen Appliances, Sinks, Taps, and Worktops are not stock items and are ordered on request. These are classed as 'special order items'. The costs and risks of returning goods to us shall be borne by you.
6.2a Standard Worktops can be returned within 7 days but will incur a collection charge of £40 plus VAT at the current rate and a restocking charge of 30% of the order value. Worktop returns after 7 days will not be accepted. Bespoke Worktops are 'Made to Order', and made to your chosen specification, and thus are not returnable or cancel-able.
6.3 Upon receipt of the goods, we will give you a full refund of the amount paid or an exchange credit as required.
6.4 The rights to cancel or return the goods to us as referred to in clause 6.3 will not apply in the following circumstances: -
in the event that the product has been used, purchased from point of sale (face-to-face), or any products that we have made to order and/or customised or specifically ordered for you through any of our Websites.
The provisions of this clause 6.4 do not affect your statutory rights.
BESPOKE, CUSTOM-MADE AND PAINTED KITCHEN PRODUCTS
6.5. Customer Responsibility
It is the customer’s responsibility to provide accurate measurements, specifications, paint colour codes for bespoke colour options, and any special instructions when placing an order. Better Kitchens cannot be held liable for errors or defects in products resulting from incorrect or incomplete information provided by the customer.
6.6. Non-Cancellable and Non-Returnable Items
Products that are made to your specific requirements, including painted kitchens and bespoke kitchen units, are non-cancellable and non-returnable once production has commenced or the products have been delivered, unless an error has been made by Better Kitchens during manufacturing.
6.7. Painted Kitchen Orders
(a) Bespoke painted kitchen orders may have minor colour variances between production batches. While we strive for consistency, an exact match cannot be guaranteed.
(b) Paint batches are held for 30 days after production begins. Any additional items requested after this time may incur additional fees and may exhibit slight colour variances.
(c) Painted products are crafted using natural materials that may develop minor cracks along joints over time. Touch-up paints are available upon request to address these minor imperfections and ensure your kitchen maintains its pristine appearance.
(d) The paint colours shown on sample doors are for guidance only and may vary slightly from the final product due to batch differences.
(e) Painted finishes may exhibit slight variations in sheen levels, which are a normal characteristic of bespoke products.
(f) Paint hardens fully over the first 4 weeks after application. To prevent damage, care should be taken during installation, or where possible, painted items should be left to harden fully before being installed.
6.8. Timber Kitchen Orders
(a) Timber is a natural material with unique features, such as knots, grain patterns, and medullary rays. These variations are inherent and contribute to the character of the product.
(b) Changes in environmental factors, such as temperature, light, and humidity, may cause subtle movement in timber products or the appearance of ‘Hairline Cracks’ along joints in painted finishes. These are normal characteristics and do not affect functionality. Touch-up paints are available to address minor surface issues that may arise.
6.9. Inspection and Quality Standards
(a) All painted and timber products are inspected to ensure high-quality finishes. Inspections are carried out at arm’s length, which is the industry-standard method for assessing such products.
(b) Products are not scrutinised under close-up conditions, as minor inclusions or surface variations may occur due to the nature of the materials. These are within standard tolerances and do not impact the overall durability, aesthetic, or functionality of the product.
LICENCE
7.1 You are permitted to print and download extracts from the Websites (www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk and www.betterbaths.co.uk) for your own use on the following basis:
(a) no documents or related graphics on these Websites are modified in any way;
(b) no graphics on these Websites are used separately from accompanying text; and
(c) any of our copyright and trade mark notices and this permission notice appear in all copies.
7.2 Unless otherwise stated, the copyright and other intellectual property rights in all material on these Websites (including without limitation photographs and graphical images) are owned by us or our licensors. For the purposes of these terms and conditions, any use of extracts from these Websites other than in accordance with clause 7.1 above for any purpose is prohibited. If you breach any of the terms in these terms and conditions, your permission to use these Websites automatically terminates and you must immediately destroy any downloaded or printed extracts from these Websites.
7.3 Subject to clause 7.1, no part of these Websites may be reproduced or stored in any other website or included in any public or private electronic retrieval system or service without our prior written permission.
7.4 Any rights not expressly granted in these terms are reserved.
SERVICE ACCESS
8.1 While we endeavour to ensure that the Websites (www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk, and www.betterbaths.co.uk) are normally available 24 hours a day, we will not be liable if for any reason these Websites are unavailable at any time or for any period.
8.2 Access to these Websites may be suspended temporarily and without notice in the case of system failure, maintenance or repair, or for reasons beyond our control.

REGISTRATION
11.1 To register with www.betterkitchens.co.uk, www.betterworktops.co.uk, www.betterbedrooms.co.uk or www.betterbaths.co.uk you must be over eighteen years of age.
11.2 Each registration is for a single user only. We do not permit you to share your username and password with any other person nor with multiple users on a network.
11.3 Responsibility for the security of any passwords issued rests with you, and if you know or suspect that someone else knows your password, you should contact us immediately.
11.4 We may suspend or cancel your registration immediately at our reasonable discretion or if you breach any of your obligations under these terms and conditions.
DISCLAIMER
